Business Property Relief (BPR) Provided by Government

A business Property relief (BPR) is the relief from Inheritance tax. It is Property Relief on the transfer of business related assets at rate of 50% or 100%. BPR minimize the transfer of money for Inheritance Tax.BPR is also available to minimize the value of property in a death estate. If all the formal conditions that are required are satisfied BPR is given automatically. There is no need to claim for BPR.SEIS

"Relevant business property"

If donor makes a transfer of "relevant business property" then BPR is provided. There are 5 types of relevant business property.

Before making a transfer a person must have controlled the company for at least 2 years.Exceptions in Sections 107 to 109.


A business or an interest in a business a partnership share. BPR is not provided on the transfer of a one business asset.

Shares in trading companies. Any number of shares

Willqualify -minimum holding.

If a person has the control of voting means he has 50% shares of the company shares.

It does not usually happen for one person to holdmore than 50% percent shares of a quoted company. Therefore in the majority of instances, shares companies are not eligible for BPR.

Land, building, plant and machinery owned by a person and used either by his partnership or his own company.

Securities problems in the company controlled by thetransferor means that the transferor also has more than 50% of the voting share.

In the case of securities (5 above), if the company is unlisted or not quoted the BPR rate is 100%, or if the company is quoted than BPR rate is 50%. "Quoted" means the company has a full listing.

Trading businesses

Section 105(3) IHTA 1984 tells us that assets"...are not relevant business property if the business... consists completely one of the following... - dealing in securities, shares or stock, land or buildings or making or holding investments". They must have shares in a trading company, and then shares become eligible for BPR. If shares are on investment companies or property dealing company then there will be no BPR.

What are the Ownership requirements?

General rule

S.107 IHTA 1984

Section 107 eligible where old property is sold and new building is constructed on in it.

S.108 IHTA 1984

Section 108 deals gifts of business property. Generally speaking, if a donor gives business assets or properties to a person as a gift, then person ownership period for BPR purposes will start at the date of the gift.

Section 109 IHTA 1984

Section 109 deals with completely transfers of property or assets in a two-year period. In the case of transfers:(a) if the earlier transfer eligible for BPR, and(b) either of the two transfers was made on death, thenBPR will be providedon the later transfer despite of the ownership period.
